A transmission is the formal process of updating the ownership of a property following the death of a registered proprietor. The process depends on how the property was owned and the circumstances of the estate.
Where a property is held in joint tenancy, the death of one joint tenant is generally dealt with by an Application to Register Death, allowing the surviving joint tenant(s) to remain on the title.
Where the deceased was the sole proprietor or held the property as a tenant in common, a Transmission Application may be required to record the executor or administrator of the estate on the title. This allows the property to be dealt with as part of the estate and, where applicable, transferred to beneficiaries in accordance with the will or relevant estate administration.
